Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the websites, products, and services (collectively, "Services") operated by sin(π) software ("we," "us," "our"), including sinpi.software, Panopticon, and any other products we offer. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Description of services

We provide administrative and process automation consulting for businesses, as well as software products including but not limited to Panopticon, an AI-powered Discord moderation bot. The specific features and availability of our Services may change over time.

Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have your parent or guardian's consent to use the Services. Our Services are not directed at children under 13, and we rely on third-party platforms (such as Discord) to enforce their own age requirements.

Accounts

Some of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion.

Acceptable use

You agree not to use our Services to:

• Violate any applicable law or regulation
• Infringe on the rights of others
• Transmit malicious code, spam, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the operation of our Services
• Use our Services to harass, abuse, or harm others
• Reverse engineer, decompile, or disassemble any part of our Services
• Use our products to circumvent or undermine the moderation or safety features of third-party platforms

Product-specific terms

Panopticon

Panopticon is an AI-powered moderation tool that processes messages and takes automated actions based on rules configured by server administrators. By adding Panopticon to a Discord server, the server administrator authorizes Panopticon to process message content and user data within that server for moderation purposes. Panopticon's moderation decisions are automated and based on the rules provided. While we strive for accuracy, we do not guarantee that every moderation action will be correct. Server administrators are responsible for configuring appropriate rules and reviewing moderation actions.

Intellectual property

All content, software, and materials provided through our Services are owned by or licensed to sin(π) software and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without our explicit written consent.

Disclaimer of warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by Washington State law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that our Services will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content, moderation decisions, or automated actions provided through our Services. You use our Services at your own risk.

Limitation of liability

To the maximum extent permitted by Washington State law, in no event shall sin(π) software, its owners, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use our Services.

Our total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless sin(π) software and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to our Services at any time, for any reason, without prior notice. Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to warranty disclaimers, limitation of liability, indemnification, and dispute resolution.

Dispute resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Washington. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Changes to these terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of our Services after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
